Addressing Your Concerns About Divorce

If you and your spouse have not yet discussed divorce, it is important to think about the best way to approach it. You should consider your physical safety as well as your financial security. We will go over these issues with you and discuss your best options.

In Texas, there are several issues that have to be resolved before a divorce can be made final, particularly when children are involved.

  • Child custody: If you have children, it will be necessary to determine how physical custody will be divided and who will be responsible for major parenting decisions.
  • Child support: Usually, when one parent gets primary custody of a child, the other parent is required to make regular child support parents.
  • Property division: In Texas, community property — which includes most types of property acquired during a marriage — has to be divided in divorce.

At minimum, a Texas divorce takes 60 days and requires one court appearance, but if you and your spouse cannot easily resolve all of the above issues, the divorce could take three months to a year and involve multiple court appearances.

Guiding You Through the Process

Family court is very different from what many of our clients expect or have seen on TV. The process can be fairly informal, and the lawyers and judge do most of the talking. You should not feel intimidated about the possibility of going to court.

But divorce is still a high-stakes situation, and it is advisable for each spouse to be represented by a lawyer. Even if you and your spouse have agreed on the terms of your divorce, our office can only advise and represent one of you. Contact us to discuss how we can help you move forward with your divorce.
